LITTLETON and WORCESTER, Mass. - April 30, 2008 - Daymark Solutions, a leading provider of information technology solutions, has joined forces with Bowditch & Dewey, LLP, a pioneer in e-discovery and technology law, to create the e-Discovery Compliance Service. The new service helps businesses and other organizations throughout New England reduce risk and ensure litigation readiness by establishing a permanent, legally defensible Document Retention Blueprint and Policy.
Lawsuits, arbitration demands and even threats of claims can trigger the legal duty to preserve evidence. The law requires that all companies preserve relevant emails and other electronic files as potential evidence, and be able to produce these files upon request during the pre-trial discovery phase. For many firms, however, complying with an e-discovery request in a timely manner drains IT resources and results in high legal bills because information is not stored in a secure yet accessible format.
"Electronic discovery can make or break a growing number of cases," said Steven J. O'Neill, partner, Bowditch & Dewey. "Left unmanaged, the cost of e-discovery alone can influence the outcome of important litigation. If e-discovery is mismanaged or ignored, especially at the early critical point where decisions about legal holds are made, costs and litigation risks may be substantially higher."
The e-Discovery Compliance Service combines Daymark's extensive IT knowledge with Bowditch & Dewey's legal expertise to address the issue of e-discovery on multiple levels. As part of the service the companies will:
- Assess the client's litigation readiness
- Evaluate the client's storage architecture
- Create a permanent document retention blueprint
- Deploy a state-of-the-art solution which will accelerate discovery of related information and meet legal records retention obligations
- Provide ongoing legal expertise to ensure all policies and protocols are technically appropriate and legally defensible
Working together, Daymark and Bowditch & Dewey will implement solutions that automate classification by record type, drastically reduce expensive attorney review time, and even implement specialized legal discovery technology that can aid legal counsel in searching for relevant original documents.
"Every company needs to be prepared to respond to a discovery request. Having the proper IT infrastructure can be one of the most critical factors in enabling legal counsel to meet a court-order deadline with accurate, defensible information," said Brian Casey, general manager, Daymark Solutions.
